In the coming days, important changes will be introduced in the field of waste traceability management. On 15 June 2023, in fact, Ministerial Decree 59/2023 will come into force, which regulates the new National Electronic Register for the Traceability of WASTE (RENTRI).
Consisting of the procedures and obligations referred to in Articles 189, 190, 193 of Legislative Decree 152/2006 (Waste Cadastre, Loading/Unloading Register, Transport Form), the RENTRI will be fully operational starting from 15 December 2024, “allowing dialogue with the management systems of users, public and private, through special interfaces, promoting administrative simplification, ensuring a preliminary period of experimentation and the sustainability of the costs borne by the members of the system”.
Main contents of the Ministerial Decree for the Environment no. 59 of 04/06/2023
With the entry into force of Ministerial Decree 59/2023, the following will be defined:
- a) the models and formats relating to the chronological registers of loading and unloading of waste and to the waste identification forms, with an indication of the methods of compilation, endorsement and keeping of the same;
- b) the procedures for registering with RENTRI and the obligations of the subjects obliged to register with the new waste traceability system, or of those who intend to voluntarily adhere to it;
(c) the operation of RENTRI, including the manner in which data relating to registers and forms are transmitted;
- d) the procedures for sharing register data with ISPRA for inclusion in the Land Registry;
(e) the interoperability arrangements for the acquisition of the documentation referred to in Regulation (EC) No 1013/2006 on shipments of waste;
- f) the methods of carrying out the technical-operational support functions by the National Register of Environmental Managers;
- g) the methods of access to the data in the register by the control bodies;
- h) the procedures for verifying and sending the communication of the start of waste recovery or disposal, as well as the responsibilities to be attributed to the intermediary.
RENTRI Experimentation
Towards the end of 2020 and the beginning of 2021, the Ministry of Energy Transition (MiTE), with the support of the National Register of Environmental Managers, started the creation of the prototype of the National Electronic Register for the Traceability of Waste, to verify its functionality and usability. The prototype experimentation has allowed the validation of an operating model that can be adopted by any subject, from the moment it becomes fully operational.
The prototype experimentation phase was developed along the following lines: support to the project governance, project structuring, prototype development, assistance to software houses in the design phase, conducting the experimentation, preparation and presentation of the end-of-activity report.
What does RENTRI consist of?
The RENTRI will introduce a digital management model for the fulfilment of obligations such as, for example, the issuance of transport identification forms and the keeping of loading and unloading registers and will be divided into two sections:
- a Registry Section of the members, including the personal data of the operators and information relating to the specific authorizations issued to them for the exercise of activities related to waste management;
- a Traceability Section, including data relating to the obligations referred to in Articles 190 and 193 of Legislative Decree no. 152 of 2006 and data relating to the routes detected by geolocation systems.
Among the main functions of the RENTRI system modules will be the accreditation of users through digital identity, the FIR issuance virtually integrated into Vi.Vi.Fir, the production of C/S registers through virtual endorsement, the communication of movement data noted in the C/S register to RENTRI and the collection of data on “traceability” movements.
Who must register for RENTRI?
The following must register with RENTRI, through accreditation to the telematic platform for the provision of data:
- a) the bodies and companies that carry out the treatment of waste;
- b) producers of hazardous waste;
- c) bodies and companies that collect or transport hazardous waste on a professional basis or that operate as traders and intermediaries of hazardous waste;
- d) the Consortia set up for the recovery and recycling of particular types of waste;
- e) for non-hazardous waste only, companies and entities that have more than ten employees and that are initial producers of non-hazardous waste from industrial processing, artisanal processing and from the recovery and disposal of waste, sludge produced by drinking water and other water treatments and by the purification of waste water and fume abatement.
What will be the timing of registration for RENTRI?
Ministerial Decree 59/2023 establishes a transitional period for registration and adaptation to the new regulation, ranging from 18 to 30 months, depending on the type and size of companies and operators.
Registration must be carried out:
– by 15/12/2024, for managers and producers of hazardous and non-hazardous waste, with more than 50 employees;
– by 15/06/2025, for producers of hazardous and non-hazardous waste, with more than 10 employees;
– by 15/12/2025, for other producers of hazardous waste.
