From 8 March 2021, a virtual system for validating the waste form called Vivifir came into force.The word Vivifir is nothing more than an acronym that stands for Virtual Validation Waste Form.
This system has been in place for more than two years, and allows, as the name suggests, to digitally endorse the waste form, following the guided procedure that allows companies and institutions to make use of a service made available online by the Chambers of Commerce, subject to registration and at no cost.
An important thing to specify is that the digital procedure does not replace paper endorsement, which remains an active option.
It is not, in fact, a total digitization since the paper printing of the form is still provided, however today the legislation on the subject also allows the use of management systems that interface with application services. The management information system is authenticated with the technical credentials and requires the issuance of the unique identifier to be reproduced, through the management system, on the form.
But what exactly are the steps to follow? Let’s see it together.
How Vi.Vi.Fir works
Vi.Vi.Fir is a service provided by the Chambers of Commerce as is the case for the paper endorsement of forms. As we anticipated at the beginning, it is not a question of a total dematerialization of the documents, but only of the endorsement procedure. The Rule introducing virtual endorsement is a revision ofArticle 193 of Legislative Decree 152/2006 introduced by Legislative Decree 116/2020, which regulates waste identification forms. The new rule establishes that: “As an alternative to the endorsement methods referred to in paragraph 3, the waste identification form can be produced in exemplary format to be printed and completed in duplicate in accordance with the decree of the Minister of the Environment 1 April 1998, no. 145, identified by a unique number obtained through a special application that can be reached through the institutional portals of the Chambers of Commerce”.
What you need to endorse the waste form
With regard to entities and companies that use IT management systems to account for waste, the possibility of resorting to virtual endorsement governed by paragraph 5 of Article 193 has been provided, which states that: “The same application makes available to those who use their own management systems for filling in the forms, dedicated access to the service also in telematic mode in order to allow the affixing of the unique code on each form.”
However, the form must be completed by the producer of the waste, who is the one who obtains the endorsement code.
In addition, the Loading and Unloading Register cannot be virtually stamped. Until the entry into force of the new Decree on traceability, the provisions of Ministerial Decree no. 148/98 and therefore the provisions relating to numbering and endorsement will continue to apply.
Vivifir compulsory and entry into force
The Waste Identification Form is the accompanying document for the transport of waste that must necessarily be issued for:
- Any type of waste transported.
- Each producer/holder of the transported waste.
- Each recovery or disposal operation for which the waste is destined.
- If a waste is destined for several recovery operations, as many forms must be issued as there are destinations of the waste. Furthermore, intermediate storage of transported waste may not be carried out using the same Form.
But how does it work specifically?
To access the vivifir.ecocamere.it portal, you must have the digital identity of the entity or company on whose behalf you are requesting the endorsement. Access can be made by a representative or delegate and can only take place with CNS (National Service Card) or SPID (Public Digital Identity System) and there is no possibility of access with other types of credentials.
In the first register, the tax code of the company represented is required. At this point, the portal will verify, through interconnection with the Business Register, that the person is entitled to represent the company. Then the personal data of the company will be retrieved and the user can continue using Vivifir.
The user thus accredited to the system will subsequently be able to delegate a third party to operate on his behalf in the Vivifir portal or request the technical credentials that will allow the management software used to authenticate through the application.
In the case of an entity not registered in the Business Register, the subject at the time of registration will indicate the tax code of the administration on behalf of which he operates and, if necessary, a unique code of the office. Vivifir sends a request for confirmation of the delegation to the institutional address in the Public Administration Index. If this is confirmed, the user can start using the service.
The novelty introduced by Vivifir is the possibility of independently producing a form that can then be filled in on the screen or by hand.
The new online service, which complements the paper endorsement, eliminates the need to physically go to the counter of the competent Chamber of Commerce for the endorsement of the pre-printed forms on chemical paper in four copies and numbered by the authorized printers.
With Vivifir, the forms are produced in PDF/A format, an international standard required by the ISO:19005 standard. This format ensures that the document can always be viewed in the same way, even after some time and with different software.
The form file is digitally signed, which guarantees the recipient the authenticity of the document. In addition, once signed with a digital ID, it is blocked to prevent it from being modified.
A further novelty of the Vivifir system concerns the number of copies of the document that must be produced. The form must be produced in two copies. The user can print only one and photocopy it after filling in by ticking the box at the bottom of the document and thus indicating whether it is the first or second copy.
The first copy remains with the waste producer and the second must accompany the waste to its destination. To ensure correct traceability, the carrier is required to keep a photocopy of the completed form. All other parties involved are advised to receive a photocopy of the form each.
