The Prime Ministerial Decree of 17 December 2021 “Approval of the Single Model of Environmental Declaration for the year 2022″ was published in the Official Gazette General Series no. 16 of 21 January 2022, as Ordinary Supplement no. 4, which must be used for the declarations to be submitted in 2022 with reference to the previous year. The deadline for submitting the MUD for waste produced or managed during 2021 has been extended to 21 May 2022.
Structure of the Single Environmental Declaration Model (MUD)
The Single Model of Environmental Declaration is divided into Communications that must be submitted by the parties required to comply.
The aforementioned provision contains the model and instructions for the submission of the following Communications:
- Waste Communication;
- communication of end-of-life vehicles;
- Packaging Communication, consisting of the Consortia Section and the Packaging Waste Managers Section;
- Waste Electrical and Electronic Equipment (WEEE) Communication;
- Communication of Urban Waste and Waste Collected in Convention;
- Communication of Manufacturers of Electrical and Electronic Equipment.
Since the deadline for delivery has been set at 120 days from the date of publication of the Prime Ministerial Decree of 17 December 2021, the 2022 MUD must be submitted by 21 May 2022.
Simplified waste communication
Subjects who, in their Local Unit,have produced NO more than seven pieces of waste and, for each of them, have used NO more than three Transporters and NO more than three final Recipients and who have delivered the waste to Recipients located on the national territorycan submit the MUD through the Simplified Waste Communication which must be filled in by entering the data in the portalhttps://mudsemplificato.ecocerved.it, signed by the declarant with a handwritten or digital signature, transformed into a PDF file and sent by certified e-mail (PEC) to the single address “comunicazionemud@pec.it“. The payment of the secretarial fee due to the Chamber of Commerce must be paid through the electronic payments circuit of the public administration, PagoPa.
The submission of the Simplified Waste Communication is excluded for Waste Producers who do NOT fall under the conditions indicated above (e.g. they produce outside the local unit or deliver abroad or transport waste produced by them).
Main changes in the 2022 MUD forms
- Inclusion in the Registry Section of a new “RECYCLING” form to be filled in by all Parties who carry out preparation operations for reuse and/or final recycling on municipal waste and/or packaging waste or on waste deriving from the pre-treatment of urban waste and/or packaging waste, including those of non-urban origin, that produce secondary raw materials, End of Waste, products and materials from recovery activities;
- Among the Subjects required to submit and compile the Urban Waste Communication, the Subjects who, as a result of art. 198, paragraph 2-bis of Legislative Decree 152/2006 deal with the collection of urban waste (art. 183, paragraph 1, letter b-ter, point 2) on behalf of third parties from non-domestic users, who must fill in some parts of the Communication, in particular the “RT-NON PUB FORM” (waste collected outside the urban collection service) attached to the RU form;
- The “CG-MANAGEMENT COSTS” form of the Urban Waste Communication has been revised to ensure greater ease of compilation;
- Additions have been made to the INSTRUCTIONS with particular regard to the indications for the compilation of the new forms implemented to better clarify the definition regarding urban waste referred to in art. 183, paragraph 1, letter b ter), point 2) of Legislative Decree 152/2006.
Subjects OBLIGED to submit the MUD 2022
- Anyone who carries out waste collection and transport activities on a professional basis;
- Waste dealers and intermediaries without detention;
- Companies and entities that carry out waste recovery and disposal operations;
- Companies and entities that initially produce hazardous waste;
- Companies and entities that have more than ten employees and are initial producers of NON-hazardous waste deriving from industrial processing, artisanal processing and from the recovery and disposal of waste, sludge produced by drinking water and other water treatments and wastewater purification, waste from fume abatement, septic tanks and sewerage networks (as provided for by Article 184 paragraph 3, letters c), d) and g) of Legislative Decree 152/06 and subsequent amendments);
- Consortia and recognised systems, set up for the recovery and recycling of particular types of waste, with the exception of Consortia and systems set up for the recovery and recycling of packaging waste which are required to fill in the Packaging Communication;
- Operators of the public collection service, of the organised collection circuit referred to in Article 183, paragraph 1, letter pp) of Legislative Decree 152/2006, with reference to waste delivered to them by producers of special waste, pursuant to Article 189, paragraph 4, of Legislative Decree 152/2006.
Subjects EXEMPTED from the obligation to submit the 2022 MUD
- Agricultural entrepreneurs referred to in Article 2135 of the Civil Code;
- Companies that collect and transport their NON-hazardous waste, referred to in Article 212, paragraph 8, of Legislative Decree 152/2006;
- For NON-hazardous waste only, the initial producing companies and entities that do NOT have more than ten employees (understood as the total number of employees of the company referring to all local units);
- Companies and entities producing NON-hazardous waste referred to in Article 184, paragraph 3, other than those indicated in letters c), d) and g); p.es. NON-hazardous waste produced in the context of agricultural, agro-industrial and forestry activities, construction and demolition activities, excavation activities, commercial activities, service activities and waste produced by health activities are exempt.
Sanctions
- Obliged Parties, who do not make the communication or make it incompletely or inaccurately, are punished with an administrative fine ranging from € 2,000.00 to € 10,000.00;
- If the communication is made within the sixtieth day from the expiry of the deadline (20 July 2022), an administrative fine ranging from € 26.00 to € 160.00 is applied.
