Regulation (EU) No. 333/2011 of 31 March 2011 “laying down the criteria determining when certain types of scrap metal cease to be waste pursuant to Directive 2008/98/EC of the European Parliament and of the Council” was the first regulatory act issued by EU bodies on the subject of End of Waste (EoW).

This Regulation, which came into force on 9 October 2011, sets out the criteria for establishing when scrap iron, steel, aluminium and aluminium alloys ceases to be waste to become a product. The heart of Regulation No 333/2011 is Arts. 3 and 4 and by Annexes I (iron and steel scrap) and II (aluminium scrap) which establish the criteria according to which iron and steel scrap and aluminium scrap cease to be waste.

Copper Scrap Regulations

 Regulation No. 333/2011 was followed by Regulation No. 715/2013 of 25 July 2013, which entered into force on 1 January 2014 and sets out the criteria for determining when copper scrap ceases to be considered waste pursuant to Directive 2008/98/EC of the European Parliament and of the Council, Article 3 of which establishes the conditions under which copper scrap ceases to be considered waste.

The aforementioned Regulations have marked an important step forward for the correct development of recycling and recovery procedures, but also for the saving of natural raw materials, putting an end to the concept of “all waste”.

Collection and transport of scrap metal

Article 40-ter of Law no. 120 of 11 September 2020 introduced simplified procedures for the collection and transport of metal materials.

In particular, the law establishes that “in order to incentivize actions for the recovery of metallic materials and promote sustainable, efficient and rational management of the same, according to the principles of the circular economy, the collection and transport activities of the same materials sent for specific recovery activities can be carried out with simplified procedures for registration in the National Register of Environmental Managers.

To this end, a register has been set up in the Register in which Italian and foreign companies can register for the purpose of enabling the exercise of collection and transport in simplified mode“.

With Resolution no. 11 of 14 October 2021,  the National Register of Environmental Managers approved the model of registration measure in the register referred to in Article 40-ter of Law no. 120 of 11 September 2020 (contained in Annex “A”) and the model of the measure refusing registration in the same register (approved according to the model contained in Annex “B”).
