What is the MUD and Current Regulations
The MUD or Single Environmental Declaration Model is the communication that entities and companies must submit every year, indicating the quantities and types of waste they have produced and/or managed during the previous year.
The Decree of the President of the Council of Ministers of 26 January 2024 approving the Single Model of Environmental Declaration (MUD) for the year 2024 (for declarations referring to the year 2023) has been published in the Official Gazette.
On the basis of Article 6 of Law no. 70 of 25 January 1994, the deadline for submitting the Single Environmental Declaration Model (MUD) is set at one hundred and twenty days from the date of publication. In view of the fact that 30 June 2024 coincides with a public holiday, the aforementioned deadline has been extended to the first following non-holiday day, i.e. 1 July 2024.
On the website of the Ministry of the Environment and Energy Security, the annexes to the D.P.C.M. approving the MUD for the year 2024 have been published, namely:
- the instructions for filling in the MUD;
- the simplified waste communication form;
- data collection models;
- the instructions for electronic submission.
On the same website you can also find a summary of the changes that have become necessary for the adaptation of the current model to the new regulatory provisions, and, in particular, for:
- introduce data from the collection of fishing gear waste in accordance with the provisions of Implementing Decision (EU) 2021/958;
- enter the items relating to the quantity of fishing gear waste divided by type of material: plastic, metals and rubber;
- update the calculation methodologies according to the instructions of the Regulatory Authority for Energy, Networks and the Environment (ARERA);
- clarify that, in the event that the declaration is submitted by Consortia, Mountain Communities, Union of Municipalities, etc. only one MDCR form must be completed.
But is the MUD mandatory for everyone?
The answer is no, considering the vastness of the areas that can affect every company.
Pursuant to the D.P.C.M. of 26 January 2024, the subjects required to submit the MUD are:
- anyone who carries out waste collection and transport activities on a professional basis, including the transport of hazardous waste on their own account (with the obligation to declare MUD also for those who carry out ferrous metal transport activities registered in the Register in category 4 bis);
- waste dealers and intermediaries without detention;
- companies and entities that carry out waste recovery and disposal operations, for example if we are talking about the administrative procedures asbestos removal (with the obligation to keep loading and unloading registers for hazardous waste for Collection Centers – art. 190, paragraph 9 of Legislative Decree 152/2006);
- initial producing companies and entities, with more than 10 employees, which produce non-hazardous waste:
- in the field of industrial processing – Article 184, paragraph 3, letter c);
- in the field of craftsmanship – Article 184, paragraph 3, letter d);
- from the recovery and disposal of waste, sludge produced by wastewater purification, as well as waste from fume abatement, septic tanks and sewerage networks – Article 184 paragraph 3 letter g);
- companies and entities that initially produce hazardous waste, with some exceptions; in fact, pursuant to Article 190 paragraph 5, the following are not required to submit the MUD: agricultural enterprises referred to in Article 2135 of the Civil Code, subjects carrying out activities falling within the scope of ATECO codes 96.02.01, 96.02.02, 96.02.03 and 96.09.02 (Services of barber and hairdressing salons, services of beauty salons, manicure and pedicure services, tattooing and piercing activities), producers of hazardous waste not part of the organization of an Entity or Company who fulfill the obligation to submit the Single Model of Environmental Declaration by filling in and keeping, in chronological order, the transport forms or the transfer document issued by the subject competent;
How to fill out the MUD
After describing what the MUD is, who is obliged to transmit it and who can do without it, let’s see how it must actually be filled in.
The structure of the MUD 2024 form does not change: it is divided into communications that must be completed depending on the waste produced and/or managed during 2023, including:
- registry section;
- waste communication;
- communication of end-of-life vehicles;
- packaging communication (consisting of the consortia section and the packaging waste managers section);
- WEEE (waste from electrical and electronic equipment) communication;
- communication of manufacturers of electrical and electronic equipment;
- communication of urban waste and collected in agreement.
The declarant must fill in and submit, in addition to the personal data section, the sections and, within these, the forms and forms relating to his or her activity.
How can the communication be made?
Communications of waste, end-of-life vehicles, packaging and waste from electrical and electronic equipment must be submitted electronically exclusively through the website.
Exceptions are the communication of urban waste and waste collected under agreement, which must be submitted electronically through the reference website, and the communication of manufacturers of electrical and electronic equipment which must be submitted electronically through the portal.
